Estate Planning, Trust Administration & Probate
Estate Planning
Estate planning services offered by Sommer Estate Law, PC encompass a range of legal tools designed to ensure your assets are managed and distributed according to your wishes.
A revocable living trust allows you to maintain control over your assets during your lifetime and specify how they should be handled after your death. A will is a fundamental document that outlines your wishes for the distribution of your property and the care of any minor children. The nomination of a guardian is crucial for parents, as it designates who will care for their children if they are unable to do so. Power of attorney grants a trusted individual the authority to make decisions on your behalf if you become incapacitated. Lastly, an advanced health care directive provides instructions for your medical care in situations where you are unable to communicate your preferences.
Together, these tools form a comprehensive estate plan that protects your interests and provides peace of mind.
Trust Administration
We help family and loved ones navigate the challenging administration process when administering an existing trust or a court probate matter.
When a family member passes away with a trust, their wishes, as stated in the trust, will need to be followed. If you have been named as Trustee, then you will need an attorney to help administer the terms of the trust. We can help you do just that.
Probate
If a family member passes away without a trust in California, then their estate must go through the probate court. If you have been named executor in the will or want to be appointed by the court to administer the estate, then you may need an attorney to help represent you. In California, fees for a probate are set by state statute and are generally paid by the estate and will not be paid by you directly.
